End User License Agreement

This licence agreement is supplementary to our general terms of business and applies for all contracts relating to software products. If you do not agree with the terms of the licence agreement, you must not install the software product.

BY USING THE SOFTWARE, YOU AGREE TO THE TERMS OF THIS AGREEMENT. IF YOU DO NOT ACCEPT THESE TERMS, YOU ARE NOT ENTITLED TO USE THE SOFTWARE.

This software copyright is owned by our Biostar Technology International, LLC. This agreement does not provide you the title or ownership of the software, but only a limited right of use.

You may not decompile, reverse engineer, disassemble or otherwise reduce the software to a human perceivable form. You may not modify, rent or resell for profit the software, or create derivative works based upon the software.

Using Unlicensed software is unauthorized use or distribution of this or any derivative works of copyrighted software will VOID your support and rights to use this software - in addition your purchase will be in forefit. It includes downloading, sharing, selling, or installing multiple copies of licensed software. Unlicensed software use also includes license infringement – installing a piece of software more times than the license permits – as well as sharing software license codes, uploading software codes to websites so others can download and use it, sharing software license codes or activation keys, as well as user IDs and passwords for web-based software applications. Unlicensed software use is illegal and can result in both civil as well as criminal penalties, including but not limited to immediate forfeit (of the license key) and (any associated cost) of this software and/or key and its support and cancellation of related membership agreements, training and access to videos and materials.

Biostar Technology International, LLC does not warrant that the software will meet your requirements, nor that the operation of the software will be uninterrupted or error-free. The software is provided 'AS IS.'

There are no other warranties with respect to the software. Biostar Technology International, LLC disclaims all other warranties, express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose or those arising from trade usage or course of dealing. No oral or written information or advice given by Biostar Technology International, LLC, its employees, distributors, dealers, or agents shall increase the scope of the above warranties or create any new warranties.

In no event will Biostar Technology International, LLC be liable to you for damages, whether based on contract, tort, warranty, or other legal or equitable grounds, including any loss of profits, lost savings, or other incidental or consequential damages arising out of your use or inability to use the software, even if Biostar Technology International, LLC has been advised of the possibility of such damage. Biostar Technology International, LLC's entire liability and your exclusive remedy shall be at Biostar Technology International, LLC's option to either return the price paid for the software or repair or replace the software. This limited warranty does not apply if the failure of the software has resulted from accident, abuse or misapplication. In no event shall Biostar Technology International, LLC's liability exceed the purchase price of the software.

If you comply with this License Agreement, you have the following rights.

Granting Of Rights Of Use. In concluding this contract for the supply of software products, the customer is granted the non-transferable and non-exclusive right to use the software that is the subject of the contract, which is restricted to the use described below. All the rights of use which are not explicitly listed here remain the property of Biostar Technology International, LLC Ltd, as the owner of all copyrights and trademark rights.

Scope of The Rights of Use. The supply of the product to the customer grants him the right to use the software that has been supplied on any computer that is suitable for the purpose. In addition the customer is explicitly granted the right to use online databases. The duration of the right of use is determined by the software product in question. The customer will be notified of the duration at the start of the contract and at every subsequent upgrade. If there is a time limit on the right to use the software which is the subject of the contract, the right to use the software ends after the expiry of the agreed period of use. The customer cannot use the software after the reference period has expired, because the software includes a time switch, which prevents it from being used for a longer period. The right to use the online database is determined exclusively by the reference period for the respective software product and ends at the same time as this period. The customer undertakes to use the product only for his own purposes and not to pass it on to third parties either free of charge or in return for payment. The software must only be used by one person on one computer. It must not be used at the same time on two or more computers, regardless of whether it is being used by the same person or different people. The customer is entitled to install and use the software on one hard disk. He is also entitled to make a backup copy of the original diskette or CD-ROM. However, this backup copy must not be used at the same time as the original version. If the customer has a contract to use a network version or a multiple licence, the customer is entitled to use the software in accordance with the terms of the contract at any time on one or more computers. The software can be used by more than one user at the same time. The customer is not entitled to create copies of the software, unless these copies are for backup purposes and are used only for this purpose. In addition, components of the software, pictures supplied with the software, the manual, accompanying documents and the documentation which forms part of the software must not be reproduced by photocopying, microfilming, by saving them electronically or by any other procedure. The software and/or the accompanying documentation must not be sold, hired, sublicensed to or in any other way made available to third parties. The customer is not entitled to pass onto third parties access codes and/or passwords for the product or for databases linked to the product. The customer is not authorised to change, modify, adapt or decompile the software and/or the accompanying documentation, in whole or in part, in any way which exceeds the limits of §§ 69d, paragraph 3, 69e of the German Copyright Act. The customer is forbidden to change the publisher's copyright information, marks/trademarks and/or ownership information in the programs or in the documentation.

Liability. Biostar Technology International, LLC Ltd. is only liable without restriction for damage to other software or to data media/data processing systems of the customer caused by the use of the software supplied by Biostar Technology International, LLC, DI Harald Rauer, in the case of intent or gross negligence. In cases of minor negligence, liability is only accepted if Biostar Technology International, LLC Ltd. has violated its cardinal obligations. In this case, Biostar Technology International, LLC' liability is limited to direct, foreseeable damage and shall not under any circumstances exceed the payment made by the customer for the software. Cardinal obligations are those obligations which are intended to preserve the sense and purpose of the licence agreement or the fulfilment of which makes possible the proper execution of the licence agreement in the first place and compliance with which the customer may rely on. Otherwise, the liability of Biostar Technology Internationalnd its officers, LLC, Ulysses Sheretov, in cases of minor negligence only is excluded. The liability of Biostar Technology International LLC and its officers, Ulysses Sheretov, due to death, physical injury, damage to health and in the event of liability under the law irrespective of blame or the acceptance of guarantees is unlimited."
