2022 Agreement Updates
We’re constantly looking for ways to improve the (“Biostar”) experience and ensure that our policies explain how our services work.
So we’re letting you know about a few updates to our (“Biostar”) Business Agreement, Terms of Service, and Privacy Policy, focusing on:
• Clarification that (“Biostar”) may only be used by those over 18 in the United States, and 18 outside of the United States;
• Updates to our dispute resolution terms;
• Supporting additional features (such as the option to Backup, Store User Data), and explaining when “Biostar” and potential collaborators might see some of your basic information;
• Additional details on our transfer mechanisms and an updated process for deletion requests; and
• An updated (“Biostar”) EULA Agreement, (“Biostar”) Services Agreement, that can cover (“Biostar”) Software, Hardware, Services and Subscriptions, and future solutions offered by (“Biostar”), with some reorganizations and revisions to ensure that the (“Biostar”) Services Agreement best reflects the current functionality of our solutions and is up-to-date with respect to changes in law.
When do these updates take effect?
The updated Terms of Service, Privacy Policy, and (“Biostar”) EULA Agreement take effect on January 1, 2022.
Will these updates affect the way I use (“Biostar”)?
You can continue using (“Biostar”) the same way you always have to store and share your stuff. But to continue to make (“Biostar”) a great place for collaboration with the people you work with, we’ve made changes to our Privacy Policy and (“Biostar”) Services Agreement that will help support additional discovery features and that help explain when (”Biostar”) and potential collaborators might see some of your basic information. For example, if you purchase a Retail License, and the Data Backups for you systems is above or below average, “Biostar” may initiate a Quality of Service check to ensure the data is being stored properly.
How old must I be to use (“Biostar”)?
To use our services, you must be at least 18 if you reside in the United States, and 18 if you reside anywhere else. If the law where you reside requires that you must be older in order to use (“Biostar”) without parental consent, then you must be that older age.
Will these updates change how my data is transferred?
No, the changes to the Privacy Policy do not impact how your data is transferred. Our changes help to clarify what legal mechanisms (“Biostar”) relies upon when transferring data from the European Union, the European Economic Area, the United Kingdom, and Switzerland.
What is the new process for submitting a data deletion request?
If you would like to request that your personal data be deleted, please fill out this form. For more information on how to control and access your personal data, please see our Privacy Policy FAQ.
What changes are you making to the dispute resolution terms in the Terms of Service?
We’ve made a number of changes to our dispute resolution terms in our Terms of Service. For example, we’ve made some changes to the process for resolving disputes informally, and we’ve made a number of updates to our arbitration provisions. Please read our updated Terms of Service to review all of the changes we’ve made.
Can I opt out of the arbitration provisions in the Terms of Service?
No. You can only discontinue the use of the software and/orhardware or service. However, if you agreed to a previous version of the Terms of Service that allowed you to opt out of arbitration, your previous choice to opt out or not opt out remains binding.
Do these changes apply to me if I’m an existing (“Biostar”) Business Customer?
Our new (“Biostar”) Services Agreement is effective January 1, 2022, and will apply to new and existing customers as of that date unless you and (“Biostar”) have negotiated and signed a separate agreement.
Why is the (“Biostar”) Business Agreement now called the (“Biostar”) Services Agreement?
The (“Biostar”) Business Agreement has been converted into a (“Biostar”) Services Agreement that can cover (“Biostar”) Software, Hardware, Services and Subscriptions, and future solutions offered by (“Biostar”). To support that change, we’ve reorganized our terms and added Service-Specific Terms in an appendix for terms that only apply to individual products or components. While the structure of the agreement has changed, the terms that apply to (“Biostar”) Business customers are substantially the same.
What if I don’t want to agree to these terms?
By continuing to use the (“Biostar”) Services, you are agreeing to our updated Terms and Privacy Policy. If, after reviewing the updates, you decide that you don’t want to agree to these terms, you can cancel your account by following the steps outlined here.
